- Health Law and Medical Malpractice Defense
Historically, the Rodey Law Firm has been a leader in defending medical malpractice, long-term care and other types of healthcare litigation in New Mexico.
We have defended more than a thousand such cases in New Mexico’s federal and state courts, including cases involving multiple plaintiffs and complex issues of causation and damages.
By assembling a multi-specialty team of nationally known experts, we have succeeded in trying or settling many of these difficult cases advantageously for our clients.
Some of our cases proceed to the appellate level. When the leading healthcare cases in New Mexico are surveyed, Rodey’s name is prominent in several dozen published opinions. Both times that the New Mexico Malpractice Act’s cap on recoverable damages has been subjected to constitutional challenge in our appellate courts, the Rodey firm has submitted briefs as amicus for the New Mexico Hospital Association and on behalf of a party supporting the cap’s constitutionality.
In addition to malpractice defense, the firm has considerable expertise in other types of litigation involving healthcare clients including: nursing home negligence, antitrust, products liability involving drugs and medical devices, commercial disputes, ERISA claims, health insurance bad faith claims, employment and civil rights claims, and medical staff disputes, including credentialing and peer review matters.
